Independent Legal Advice for Joint Borrower Sole Proprietor (JBSP) Mortgages

What is a Joint Borrower Sole Proprietor (JBSP) mortgage?

A Joint Borrower Sole Proprietor mortgage lets someone — often a parent, step-parent or other family member — join a mortgage to boost the main applicant's borrowing power, without being named on the title deeds. The 'sole proprietor' owns the property; the 'joint borrowers' share full responsibility for the mortgage repayments. JBSP arrangements are commonly used to help first-time buyers whose income alone would not stretch to the home they need.

It is a generous thing to do, but it is also a serious legal commitment. That is why lenders ask the supporting borrower to take independent legal advice (ILA) before completion.

Why does the lender require independent legal advice?

As a supporting borrower on a JBSP mortgage, you take on all the obligations of the loan but receive none of the ownership. The lender wants to be sure you understand this imbalance, that you are signing freely and without pressure, and that you cannot later claim you did not know what you were agreeing to. A certificate of independent legal advice — signed by a legal adviser who acts for you alone, not for the lender or the buyer — provides that assurance and protects everyone involved.

Most JBSP lenders will not release funds until they have received the ILA certificate, so it is worth arranging your appointment early to keep your completion date on track. The main risks, in plain English

None of this is meant to alarm you — thousands of families use JBSP mortgages successfully every year. But before you sign, you should clearly understand that:

  • You are fully liable for the whole mortgage. If the main borrower misses payments, the lender can pursue you for the full amount — not just a share.
  • You get no ownership in return. Your name is on the mortgage, not the deeds, so you have no automatic right to the property or any rise in its value.
  • Your credit rating is on the line. Missed payments affect your credit file just as if it were your own mortgage.
  • It can limit your own borrowing. Lenders will count the JBSP mortgage as your debt when you apply for credit or a mortgage of your own.
  • Getting out is not automatic. You usually stay liable until the property is sold, the mortgage is repaid, or the lender agrees to remove you — typically by remortgage.

Who typically needs ILA for a JBSP mortgage?

Most commonly it is parents helping a child buy their first home, but we also regularly advise siblings, grandparents, other relatives and partners joining a mortgage without going on the deeds. If more than one person is supporting the borrower — for example, both parents — each supporting borrower normally needs their own advice and certificate, and our fixed fee applies per person. The property owner themselves does not usually need ILA unless the lender or their solicitor asks for it.

Do both parents need separate ILA appointments for a JBSP mortgage?

Usually, yes. Each supporting borrower normally needs their own independent advice and their own certificate, and our fixed fee applies per person. We can often arrange appointments close together on the same day so you are not waiting around.

Will your certificate be accepted by my JBSP lender?

Our certificates are prepared to satisfy standard lender requirements and are relied on by borrowers completing with major UK lenders. If your lender uses its own form of certificate, we will complete that instead — just email it to info@ilahub.com when you book.

How quickly can I get my JBSP ILA certificate?

On every tier, your certificate is emailed the same working day as your appointment. The fee tier only affects how soon the appointment is: Standard (£150) within 2–3 working days, Fast Track (£250) from the next working day, and Priority Same-Day (£350) for the earliest slot, including same day.

Does the person buying the property need independent legal advice too?
