Independent Legal Advice for Equity Release & Lifetime Mortgages

Releasing equity from your home? Your lender will need a signed certificate confirming you have received independent legal advice. We provide it by secure video call, with the certificate emailed the same working day.

What is equity release?

Equity release lets homeowners — usually aged 55 and over — unlock some of the value tied up in their home without having to sell it and move out. The most common form is a lifetime mortgage: a loan secured against your home, with the interest typically rolling up over time rather than being paid monthly. The loan and interest are normally repaid when the property is sold, most often after you die or move into long-term care. Some plans allow voluntary repayments or interest servicing along the way; a smaller number of arrangements work as home reversion plans, where you sell a share of the property instead.

Because these products affect your home, your estate and potentially your entitlement to means-tested benefits, they come with more built-in safeguards than an ordinary mortgage — and independent legal advice is one of the most important.

Why is independent legal advice required?

Lenders and industry standards — including those set by the Equity Release Council — expect anyone taking out an equity release plan to receive independent legal advice before completion. The adviser must be separate from the lender and from your financial adviser, so you get a genuinely impartial explanation of what you are signing.

The purpose is twofold. First, it protects you: someone with no stake in the transaction confirms you understand the terms, the costs and the long-term consequences. Second, it protects the lender: the signed ILA certificate is evidence that you entered the plan freely, with full understanding and without pressure from family members or anyone else. Most lenders will not release funds until they have this certificate. Equity release is a legitimate, regulated product that works well for many people. But it is a long-term commitment, and the advice appointment focuses on making sure you are comfortable with points like these:

  • Interest can grow quickly. With a roll-up lifetime mortgage, interest is added to the loan and then attracts interest itself, so the amount owed can rise significantly over the years.
  • Your estate will be smaller. The loan is repaid from your home's value, which reduces what you can leave to family — though most modern plans include a no-negative-equity guarantee, so you should never owe more than the home is worth.
  • Early repayment can be expensive. Paying the plan off early may trigger substantial early repayment charges.
  • Benefits and care funding may be affected. Releasing a lump sum can affect means-tested benefits and how future care costs are assessed.
  • It is a lifelong arrangement. The plan is designed to run until you die or move into permanent care, so it needs to suit your long-term plans, not just today's needs.

None of this means equity release is the wrong choice — it means the decision deserves a clear, unhurried explanation before you commit, which is exactly what the appointment provides.

Who typically needs an ILA certificate for equity release?

Most commonly, homeowners aged 55+ taking out a new lifetime mortgage or home reversion plan. It also applies to couples releasing equity jointly — each borrower needs their own advice — and sometimes to further advances or drawdowns on an existing plan where the lender asks for a fresh certificate. If a family member is living in the property, the lender may ask them to take independent advice and sign an occupier consent form too; we can help with that as well. Frequently asked questions

Do I need independent legal advice for equity release?

Yes, in almost every case. Lenders and Equity Release Council standards expect each borrower to receive independent legal advice before an equity release plan completes, and the lender will normally not release funds until it has the signed certificate confirming that advice was given.

Do both of us need advice if we are releasing equity jointly?

Yes. Each borrower needs their own independent advice, and our fixed fees are charged per person. Couples can usually be seen in the same video appointment, and each person receives the certificate their lender requires.

How quickly can I get my equity release ILA certificate?

Your certificate is emailed the same working day as your appointment on every tier. The fee only affects how soon the appointment itself takes place: Standard (£150) within 2–3 working days, Fast Track (£250) from the next working day, or Priority Same-Day (£350) at the earliest available time, including same day.

My lender has sent its own certificate form — can you complete it?

Yes. Our certificates are prepared to satisfy standard lender requirements, but if your lender or solicitor has issued a specific form, email it to info@ilahub.com and your adviser will complete that version during your appointment at no extra charge.
